Applicable law

These Terms and the use of this website are governed exclusively by Belgian law. Any dispute arising from these Terms shall be brought before the courts and tribunals of Brussels.

Miscellaneous

If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be deemed not to exist and shall not affect the validity and enforceability of the remaining provisions. Decola Nutraceutics reserves the right to update these Terms and to modify the content of its website at any time.

Terms of sale

All complaints regarding delivered goods, terms, or other matters must reach us at our address within 8 days after delivery, and in no case shall such complaints give rise to non-payment of any amounts due. Hidden defects must be reported in the same manner within 8 days after their discovery.

Any delivery times indicated are provided as guidance only and are approximate. We do not assume any formal obligation to achieve a specific result regarding delivery times. The mere expiry of a delivery period can never be considered a formal notice of default.

All goods delivered remain our property until full payment has been received, notwithstanding Article 1583 of the Belgian Civil Code. This clause is essential and no waiver of it shall be presumed.

Any mutual claims shall always be settled by set-off.

Invoices are payable in cash, unless otherwise agreed in writing.

Prices are always ex-warehouse/shipping depot and shipping costs will be charged, unless otherwise agreed and explicitly stated.

All invoices and any amounts due are payable at the seller’s registered office.

These general terms and conditions are governed by Belgian law. In the event of any dispute whatsoever, only the courts of Bruges shall have jurisdiction.

Acceptance of payment by cheques, bills of exchange, promissory notes, and similar instruments does not change the jurisdiction clauses agreed above, as such acceptance does not constitute novation of the debt.

In the event of non-payment on the due date, interest at 15% per year shall be due automatically and without any notice of default, calculated from the due date until the date of payment. In addition, under the same conditions, the seller is entitled to apply a fixed compensation fee of 20% on the total amount due, with a minimum of EUR 40.00.

Right of withdrawal

You have the right to withdraw from the agreement within 14 days without giving any reason.

The withdrawal period expires 14 days after the day of delivery.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from the agreement by an unequivocal statement (for example in writing by post, fax, or email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from the agreement, we will reimburse all payments received from you up to that point, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event no later than 14 days after we are informed of your decision to withdraw. We will reimburse you using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any case, no fees will be charged for such reimbursement.
